Terms and Conditions of Use

You must read and agree to these Acceptable Use Policies & Terms and Conditions of Service before you will be allowed to use Our Gallery's hosting services. Please read them carefully.

In order to provide the best possible services to all of our clients, each client must agree to the following rules:

Principles Of Acceptable Use By Client

Responsibility - The Client recognizes that the Internet is intended for use by all citizens, and client shall, at all times, act with respect, courtesy and responsibility, giving due regard to the interests and rights of other Internet users as follows:

a) Compliance with Law - The client will ensure that its use of the Internet complies with all applicable federal, state and local laws and regulations, including, copyright law, trade secrets, proprietary information, intellectual property rights; libel or defamation of character, invasion of privacy, and the exportation of restricted technical or military data to prohibited countries - whether or not such knowledge of exportation restrictions was known or not.

b) Knowledge of the Internet - The client agrees to obtain a basic knowledge of the Internet and its operating principles and practices and procedures.

c) Security - The client is required to protect the security of its Internet account and the usage of that account. The client's password is strictly private and will be treated as confidential and as such, not disclosed or shared with any third parties by the client.

d) Validity of Information - The client is responsible for validating the integrity, accurateness and truthfulness of the data it receives or transmits over the Internet.

e) Improper Use - The client will avoid mass mailings and mass advertisements (SPAM), pirating or copying of software, mail bombing or other methods of attempting to deny service or access to other users, including attempts to violate security and system integrity.

Additional Terms and Conditions

1. Setup Fees - The client is responsible for paying the appropriate setup fee. Setup fees are non-refundable.

2. The account will be billed on a monthly, quarterly or yearly basis as chosen by the client. If the client fails to make the agreed payments in a timely manner (within 15 days of the billing), Our Gallery will reserve right to revoke the ID and password of the client, and remove all domains for which the client is responsible from the Internet, put the account on hold, cancel the account, or all of the above.

3. Payment for the appropriate services may be made by automatic credit card debit.

4. Our Gallery requires written notification by electronic or conventional mail, prior to modification of any InterNIC domain name registration submission form or assignment or transfer of a domain to any other person or entity.

5. Client must promptly inform Our Gallery of the following: changes in the expiration date of any credit card used in connection with the hosting service; changes in business/home or billing address; and apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until Our Gallery is notified, by electronic or conventional mail, or by telephone at 217-204-3403, of a breach in these securities, the client will remain liable for any unauthorized use of the services.

6. Subscription to Our Gallery's hosting services may be terminated at any time by Our Gallery for cause, and without cause, by either Our Gallery or the client after the first month and upon notification of the other by electronic or conventional mail, or by telephone. Clients are liable for charges incurred by them until termination of service.

7. Clients are responsible for providing all personal computer and communications equipment necessary to gain access to the hosting service, if they elect to maintain their own websites. Access to and use of the Service is through a combination of an ID and a password. Each client must keep their password strictly confidential. Remember your password! For security reasons, Our Gallery will not release passwords for any reason. Unauthorized access to the domain is a breach of this Agreement and a violation of law.

8. Any liability of Our Gallery including without limitation, of any failure of servers, performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause or action, shall be strictly limited to the amount paid by or on behalf of the client to Our Gallery for the time such service to the Internet is interrupted. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

9. No warranty is made by Our Gallery regarding any information, services, or products provided through or in connection with the domain or the hosting of the domain by Our Gallery. Our Gallery also hereby expressly disclaims any and all warranties, including without limitation: a) any warranties as to the availability, accuracy, or content of information, products, or services; b) any warranties of merchantability or fitness for a particular purpose of products or services provided by domains hosted by Our Gallery.

10. Our Gallery enables clients to post their own websites, but clients agree not to submit, publish, or display on their websites any defamatory, adult, inaccurate, abusive, threatening, racially offensive, or illegal material. Transmission of such material that violates any federal, state, or local law, is prohibited, is a breach of this Agreement and will constitute just cause for immediate removal of all domains under the responsibility of the offending party/parties.

11. Clients are responsible for information they send or display through their domain(s) even if a claim should arise after termination of service.

12. All questions, complaints, or notices to Our Gallery by means of electronic message must be sent to webmaster@ourgallery.net

13. Clients who contract for website maintenance by Our Gallery must submit all requests for changes to their websites by e-mail, conventional mail or fax at least two (2) weeks before the change is to take effect. Our Gallery cannot by responsible for errors in material submitted by the client. Checking of copy after the changes are posted is the responsibility of the client and any errors will be corrected as soon as possible after they are reported by e-mail, conventional mail or fax, usually within 48 hours. Financial responsibility for errors which are the responsibility of Our Gallery in maintenance of a client's website shall by limited to the amount of the pro-rated hosting fees attributable to the time period in which the error is active on the domain.

15. This Agreement contains the entire agreement between the client and Our Gallery regarding the use of the domain hosting and related services and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by Our Gallery to clients. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its terminations. The Agreement shall be governed by the laws of the State of Illinios.
